What Is The ‘Fresh Start’ Program?

The Fresh Start initiative makes it easier for individuals and business taxpayers
to pay back taxes, avoid IRS tax liens, and get tax relief from the IRS.

5 Star Tax Relief Team

State Tax Agencies and the IRS have little sympathy toward high income earning taxpayers. The higher is your liability, the bigger a target you are perceived to be! Our 5-Star Tax Relief Team will always place the utmost importance into devising a game plan to protect client’s prosperity. Whether we re-initiate the fight with the examination division (through a re-audit) or engage directly with large dollar collections and/or Complex Account Recovery, you can rest assured that we will provide you with the strongest possible defense.

Tax Law Advisory has extensive experience and long record of success representing those with multi-million dollar liabilities. We are seasoned in high dollar/high stakes tax issues and use our wealth of experience to benefit our clients.

Hire Our 5-Star Tax Counsel

If you own a business with a tax burden in the seven figures, or are an individual filer whose tax debt has spun out of control and owe in the millions, our staff of experienced professionals is well equipped to negotiate on your behalf and protect your assets from IRS or State collections and seizure.

Tax Negotiation & Settlement

Our Lawyers will Negotiate with the IRS or State Tax Authority on your Behalf

Over $10k IRS Installment Agreements, State Tax Settlements, Payroll Tax Plan, Sales Tax Payment Help

  • Individual/Family Tax Payers – If you’re financially unable to pay your tax debt immediately, we can help you make monthly federal tax payments to the IRS through an installment agreement. As long as you pay your federal tax debt in full, we can reduce or eliminate your payment of penalties or interest, and avoid the IRS fee associated with setting up the agreement.
  • Small Businesses – with employees we can help create an in-Business Trust Fund Express installment agreement. Such an installment agreement may even not require a financial statement or financial verification for our negotiation process.
  • State or IRS Audit – we can help you prepare for an audit and then represent you as your legal representative. If you are facing a Sales-Tax audit or Payroll audit as a business owner, we can be your legal representative before the State Employment Development Department, or the IRS.

Negotiating an IRS Compromise

If you will never be able to pay your tax debt in full because of an undue hardship, our specialist will negotiate an IRS Offer In Compromise by which the taxation authority may agree to accept a lesser amount of back taxes and wave all penalties.

Tax Liens & Levies

IRS Liens Can Demolish Your Good Credit and Borrowing Capacity!

Because Federal Tax Liens are public records they will show up on your credit report. This often makes it difficult and sometimes even impossible for a taxpayer to obtain any financing, even for an automobile or a home.

Bank Account Levies Can Empty Your Checking and Savings!

When the IRS levies a bank account, the bank is required to remove whatever amount is available in your account that day (up to the amount of the IRS levy) and send it to the IRS within 21 days, unless notified otherwise by the IRS.

Regular Earnings Levies Can Take Away Most of Your Paycheck!

Wage levies are filed with your employer and remain in effect until the IRS notifies the employer that the wage levy has been released. Most wage maybe taken from your paycheck so you may have an insufficient amount of money on which to live on.

End Wage Garnishment

We Can Help Put An End To Wage Garnishment

Stop the Wage Garnishment

By getting back into good standing with the IRS you will be able to stop a wage garnishment. You do not necessarily have to have paid the IRS in full to but enter into a negotiated settlement. Various programs are available to help taxpayers get back into good standing. Here, one of our experienced tax attorneys will be able to guide you to the program that will work best for your specific situation.

Below are some of the methods available to halt wage garnishment:

Get an Installment Agreement – The IRS will stop a wage levy once you have entered into an installment agreement with them. An installment agreement works like other loans or credit cards: you must make your agreed upon monthly payments including interest until the amount owed is paid off.

Submit an Offer and Compromise – The Offer In Compromise Program or (OIC) allows a taxpayer to settle the tax liability for less than the amount owed. While not everyone will qualify, once you have submitted a proposal for an Offer in Compromise the IRS will halt wage garnishments during the negotiation process. This may be a way to buy time to search for another program should your offer be rejected.

Declare Uncollectable or Hardship Status – it may be possible to show that paying the IRS will place a family under undo financial hardship. Hardship status is temporary but can last for months or even years if economic conditions o not improve. One of our attorneys can file to have hardship status placed on the case and this will end the wage garnishment as well as allow time to find a more permanent tax debt solution.

Examples of Our Successful Work

Hi Deqi,

I wanted you to know that we received a letter today from the Indiana Department of Revenue stating that they have accepted the OIC. We are so happy they have agreed to it without requiring a down payment.

The agreement is that we will pay $300.00 a month from 1/2016 to 6/2016 and beginning 7/2016 $800.00 a month.

Thank you SO much for all your work on our behalf. We couldn’t have done this without your help!

I would love to tell your boss how pleased we are with your work, could you give me his/her email address?:) Thank you! Lisa B.

Our purpose in posting the above email received from a client who is happy with the service she has received from us, is intended to show what our services can do for our clients.

She owed the State $119,243.01 and every day $5.54 was accruing as interest. Her bank account was levied. We collected documents from her and helped prepare a hardship claim and we were successful in having the bank levy removed. We were further able to have our (Offer in Compromise) request approved by the State.

Under the OIC program, the client’s balance of $67,150.24 was reduced by $52,092.77 to $15,057.47 with no accruing interest. She will have 7 years to pay off the $15,057.47, with a payment arrangement that the client is comfortable with!

The client has agreed to post positive reviews on our BBB site and Yelp account.

Case Background

Gerd K. owes the IRS $23,658.19 in total for 2001-2003, and the CSED will run out in another 11-12 months (tax returns for these 3 years were filed on 8/16/2006).

So if required to pay under the installment agreement of 11-12 months, the monthly payment will be around $2,010, an amount that the client can’t afford.

About CSED

CSED represents the last date the IRS can collect back taxes from the client. When the CSED is approaching, the IRS may possibly take more robust than normal actions, to collect as much as possible from the concerned taxpayers before the CSED expire, after which they will lose the legal right to do so.

CSED may stop running on some occasions, for example, when the Offer in Compromise is being reviewed by the IRS. When CSED stops running, the IRS will have an extension of time to collect back taxes from the taxpayers. Sometime the IRS may get an extension of CSED by other means, for example, when the IRS allows a collectible client more time to pay off back taxes. Both of the situations are disadvantageous for the taxpayers.

Our strategy and approach:

Based on the analysis of the client’s financial status, we tried to help the client take advantage of the CSED by establishing economic hardship, aiming at the client paying nothing.

We helped the client establish his economic hardship, so the IRS can not take aggressive collection actions, such as bank levy or wage garnishment. Also we helped the client apply for a CNC (Currently Non Collectible) status.

The best thing about being in a CNC status is the CSED will not stop running when the taxpayer is in a CNC status. Which means that within a year under the CNS status, the CSED for Gerd K. will expire, and no other extension of the CSED can be granted by the IRS. As a result, Gerd K. will be completely free of the back taxes of $23,658.19.

In this case, taking advantage of CSED by establishing economic hardship and applying for CNC status, is a much better solution than Offer in Compromise or Installment Agreement.

The IRS did not take further collection actions and they approved the CNC status. The client got the IRS letter confirming the CNC status, and he is safe now and will be completely free of the back taxes of $23,658.19 in a year.

Every case is different due to specific details, the success of Gerd’s case is not a guarantee of success in every case. But, this precedent should be encouraging!

We have received a thank you email from a client, for whom we have helped obtain a favorable IRS Installment Agreement despite substantial equity.

The value of this Installment Agreement is to allow them enough time to wait for the opportunity to sell or borrow against their second house, absent any threats of foreclosure by the IRS.

Case Background

Our clients are Civil Attorneys, they owed close to $100,000.00 to the IRS because their business had some difficulties.

With high net equity on their homes, their current home is worth $327,187.00 with an equity of $69,723.00. They also own a second house with an equity of $513,182. In addition, the client also inherited a trust which owns a vacation house and thousands of dollars in the bank.

The client’s concern was whether the IRS will agree to any offer, given the assets and equity they possess. The IRS would have been within its rights to foreclose on any of their properties.

What may happen to high net equity clients

To collect back tax debt, the IRS can levy bank accounts, garnish wages, pensions and social security payments. They also have the power to foreclose on real estate properties. The IRS might not be able to foreclose on primary homes, however, in cases where there are multiple properties, the IRS can go after those.

Foreclosure is usually the last resort for the IRS. The IRS will most likely petition a tax payer with a high net equity to borrow against their equities. If there is the possibility of borrowing, the IRS would most likely deny any low monthly payment Installment Agreement request.

How we helped this client:

We gathered all information about their income and expenses, to establish a low or negative net income for the clients.

We carefully examine client’s equity in multiple assets.

We discussed with the client on the installment agreement and came up with a proposed payment of $400 a month to the IRS.

We got all the above examined, discussed and documented.

After we presented the information to the IRS, the IRS had us to wait for 2 weeks when they did internal processing. And after 2 weeks, the client got a letter yesterday which confirmed the IRS agrees the client to pay $400 a month starting from this March 28.

There are cases in which we may not be able to obtain an OIC (offer-in-compromise) on behalf of our client, mainly due to the client’s own ineligibility. However, a well-designed installment agreement can also help a client satisfy the IRS thereby mitigating any financial hardship they might have been subjected to. Our job is to build and establish a solid case from which we can negotiate a favorable settlement on behalf of our clients.
