Our purpose in posting the above email received from a client who is happy with the service she has received from us, is intended to show what our services can do for our clients.

She owed the State $119,243.01 and every day $5.54 was accruing as interest. Her bank account was levied. We collected documents from her and helped prepare a hardship claim and we were successful in having the bank levy removed. We were further able to have our (Offer in Compromise) request approved by the State.

Under the OIC program, the client’s balance of $67,150.24 was reduced by $52,092.77 to $15,057.47 with no accruing interest. She will have 7 years to pay off the $15,057.47, with a payment arrangement that the client is comfortable with!

ATTORNEY’S NOTES:

Case Background

Gerd K. owes the IRS $23,658.19 in total for 2001-2003, and the CSED will run out in another 11-12 months (tax returns for these 3 years were filed on 8/16/2006).

So if required to pay under the installment agreement of 11-12 months, the monthly payment will be around $2,010, an amount that the client can’t afford.

About CSED

CSED represents the last date the IRS can collect back taxes from the client. When the CSED is approaching, the IRS may possibly take more robust than normal actions, to collect as much as possible from the concerned taxpayers before the CSED expire, after which they will lose the legal right to do so.

CSED may stop running on some occasions, for example, when the Offer in Compromise is being reviewed by the IRS. When CSED stops running, the IRS will have an extension of time to collect back taxes from the taxpayers. Sometime the IRS may get an extension of CSED by other means, for example, when the IRS allows a collectible client more time to pay off back taxes. Both of the situations are disadvantageous for the taxpayers.

Our strategy and approach:

Based on the analysis of the client’s financial status, we tried to help the client take advantage of the CSED by establishing economic hardship, aiming at the client paying nothing.

 

We helped the client establish his economic hardship, so the IRS can not take aggressive collection actions, such as bank levy or wage garnishment. Also we helped the client apply for a CNC (Currently Non Collectible) status.

The best thing about being in a CNC status is the CSED will not stop running when the taxpayer is in a CNC status. Which means that within a year under the CNS status, the CSED for Gerd K. will expire, and no other extension of the CSED can be granted by the IRS. As a result, Gerd K. will be completely free of the back taxes of $23,658.19.

In this case, taking advantage of CSED by establishing economic hardship and applying for CNC status, is a much better solution than Offer in Compromise or Installment Agreement.

Result:

The IRS did not take further collection actions and they approved the CNC status. The client got the IRS letter confirming the CNC status, and he is safe now and will be completely free of the back taxes of $23,658.19 in a year.

Reminder:

Every case is different due to specific details, the success of Gerd’s case is not a guarantee of success in every case. But, this precedent should be encouraging!

We have received a thank you email from a client, for whom we have helped obtain a favorable IRS Installment Agreement despite substantial equity.

The value of this Installment Agreement is to allow them enough time to wait for the opportunity to sell or borrow against their second house, absent any threats of foreclosure by the IRS.

Case Background

Our clients are Civil Attorneys, they owed close to $100,000.00 to the IRS because their business had some difficulties.

With high net equity on their homes, their current home is worth $327,187.00 with an equity of $69,723.00. They also own a second house with an equity of $513,182. In addition, the client also inherited a trust which owns a vacation house and thousands of dollars in the bank.

The client’s concern was whether the IRS will agree to any offer, given the assets and equity they possess. The IRS would have been within its rights to foreclose on any of their properties.

What may happen to high net equity clients

To collect back tax debt, the IRS can levy bank accounts, garnish wages, pensions and social security payments. They also have the power to foreclose on real estate properties. The IRS might not be able to foreclose on primary homes, however, in cases where there are multiple properties, the IRS can go after those.

Foreclosure is usually the last resort for the IRS. The IRS will most likely petition a tax payer with a high net equity to borrow against their equities. If there is the possibility of borrowing, the IRS would most likely deny any low monthly payment Installment Agreement request.

How we helped this client:

We gathered all information about their income and expenses, to establish a low or negative net income for the clients.

We carefully examine client’s equity in multiple assets.

We discussed with the client on the installment agreement and came up with a proposed payment of $400 a month to the IRS.

We got all the above examined, discussed and documented.

After we presented the information to the IRS, the IRS had us to wait for 2 weeks when they did internal processing. And after 2 weeks, the client got a letter yesterday which confirmed the IRS agrees the client to pay $400 a month starting from this March 28.

Conclusion:

There are cases in which we may not be able to obtain an OIC (offer-in-compromise) on behalf of our client, mainly due to the client’s own ineligibility. However, a well-designed installment agreement can also help a client satisfy the IRS thereby mitigating any financial hardship they might have been subjected to. Our job is to build and establish a solid case from which we can negotiate a favorable settlement on behalf of our clients.
